Frequently Asked Questions

Was I wrongfully dismissed?

Wrongful dismissal occurs when an employer terminates an employee without cause and without providing adequate notice or pay in lieu of notice under the ESA or common law. If you were let go without the proper entitlements, you may have a claim.

What is constructive dismissal?

Constructive dismissal occurs when an employer makes a significant, unilateral change to the terms of your employment — such as a major pay cut, demotion, or change of duties — that effectively forces you to leave. You may be entitled to treat this as a termination and claim accordingly.

How long do I have to file a complaint?

For ESA claims, you generally have two years from the date the violation occurred to file a complaint with the Ministry of Labour. Time limits also apply to civil claims. Do not wait — contact us early.
